This is where we tell you all about the legal terms and conditions that apply to the use of the Ligaia IVS (“Ligaia” or the “Company”) Website and Platform.
It’s important that you read them, because this is where we spell out our responsibilities as website owners, and yours as a website user. By registering with us and using the site you are accepting these terms and conditions and are legally bound by them. If you don’t wish to be bound by the terms and conditions, then you shouldn’t use ligaia.com, all other sites owned and operated by Ligaia that redirect to ligaia.com, and all subdomains (collectively, the “ Site” or “Platform”) and services owned and operated by the Company (together with the Site, the “Service”).
We may make changes to these terms and conditions at any time. If we do we will post these changes here and they will be effective immediately. Please check regularly so that you are aware of any changes, as once they appear here, if you use the website, it means that you accept them. This was last updated April 25th 2016.
Registration and Your Responsibilities
If you are under eighteen you may only use this site with the agreement of a parent or guardian.
You may view Content on the Site without registering, but as a condition of using certain aspects of the Service, you may be required to register with Ligaia and provide your name, email adresse (“User ID”) and password.
You agree that your name, email address, your home address and your phone number can be used as means of communication from us to you.
You warrant that all the information you provide to Ligaia for the purpose of registering with us, obtaining a Ligaia Certificate and opening a Ligaia account for you is true, complete and current. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your account.
When you register with us you must choose a password. You are solely responsible for all actions taken under your password and you must only use the Ligaia website under your own password. Ligaia reserves the right in its sole discretion to refuse registration of or cancel a User. It is your responsibility to keep your password safe and to ensure that it is not disclosed to anyone. If you think someone else might know it, you must change it. You must not permit anyone else to use your password nor shall You never use another Users account. You will immediately notify Ligaia in writing of any unauthorized use of your account, or other known account-related security breach.
You also warrant that the credit or debit card you use for Ligaia transactions is your own, and that there are sufficient funds available to cover your payments.
Privacy Policy
We take your privacy very seriously. We will not pass on your personal, debit or credit card details to anyone other than our banking partners. For full details of who they are, please see the section on our partners (link to bank and transaction partners). For more details of how we protect your privacy read our privacy policy (link to our privacy policy).
Digital Certificate and Conditions
Ligaia has leased a platform to give you a digital certificate for you donation to show your share and the total progress of all doners towards the goals of “Human” and “Green Donations”. Human donation will go to foundations or Non Profit Organisations like ‘Pencil of Promises’, UNICEF or similar. Green Donations will go to Projects or Non Profit Organisations like ‘plantations to sequester CO2’, recovery of original rainforests or sustainable energy.
By donating, you agree to be bound by this entire Agreement, including the following terms:
- Donors agree to provide their payment information at the time they pledge to the Site. The amount Donors pledge is the amount they will be charged.
- Donors consent to Ligaia and its payments partners authorizing or reserving a charge on their payment card or other payment method.
- The pledge is divided in 3 parts: the “Human Donation”, the “Green Donation” and the “Leasing and Administration Fees”.
- Ligaia does not offer refunds. The right of returns does not apply to donations, whether cash or certificates. This donation will be issued to the chosen charities and the charity organisation is not required to grant a Doner’s request for a refund. Nor are the doner entitled to contact the charity organisation for refunds.
- The administration fee will prepay for the hosting of the digital certificate for the 20-25 years from the time of donation to provide you with information of your share and the progress of the overall goals. And to provide feedback on the distribution of donation made from the profits at time of harvest.
- Profits from the thinning process approximately at year 5 and 10 will be accounted. Ligaia has the exclusive rights to choose 3-5 options how profit is distributed within the frame of Human or Green Donations. The donors will be notified by the platform about the distribution .
- Profit from harvesting the Plantation approximately at year 20 will be accounted. Ligaia has the exclusive rights to choose 3-5 options how profit is distributed, from which the Donor’s can pick, within a announced timeframe. The donors will be notified by the platform. If Donor’s haven’t chosen within the announced timeframe, Ligaia will have the full right to allocate the profit to the issued options within the frame of Human or Green Donations.
- Ligaia and its payments partners will remove their fees before transmitting proceeds. All fees are included to the stated price unless it is explicit said otherwise. Fees may vary depending on region and other factors.
- Ligaia reserves the right to cancel a pledge at any time and for any reason.
- Ligaia reserves the right to reject, cancel, interrupt, remove, or suspend a Vendor at any time and for any reason. Ligaia is not liable for any damages as a result of any of those actions. Ligaia’s policy is not to comment on the reasons for any of those actions.
- Ligaia is not liable for any damages or loss incurred related to rewards or any other use of the Service. Ligaia is under no obligation to become involved in disputes between any Users, or between Users and any third party arising in connection with the use of the Service. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties, or representations associated with Site on the website. Ligaia does not oversee the performance or punctuality of the Sites. You release Ligaia, its officers, employees, agents, and successors in rights from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and the Service.
Payment
Your payments to us go to the pledged service account and and then onwards to 3 parts: “Human Donation”, “Green Donation” and “Leasing and Administration Fees”. Ligaia accepts most major debit cards. Ligaia does not hold onto your bank details. If you choose to give these details to us in order to pay, they will be passed on to our banking partners and held securely as with any other banking transaction.
Our Fee
Ligaia platform fee is included in the in the price pledged for the donation. The fee is paying for your access pr. unit, from purchase and to harvest, so you can follow the process of the “Human Donation” and the “Green Donation and vote for the profit distribution. Unless otherwise stated at the moment of purchase there will not be added any monthly fee.
Changing Your Mind
If you register and donate with Ligaia platform and then change your mind, please let us know. We can’t give any refunds, but we can cancel your account, if you contact us in writing (link with support@ligaia.com). If you cancel your account your you will not be able to access your certificate in the future nor be able to vote for future donation distribution. The cancelation is permanent.
Returns:
Ligaia does not offer refunds. The right of returns does not apply to donations, whether cash or certificates. This donation will be issued to the chosen charities and the charity organisation is not required to grant a Doner’s request for a refund. Nor are the doner entitled to contact the charity organisation for refunds.

Vendor term (Plantation owners)
The plantagen owner will provide the information for: locations for tree planting, age and quality of the tree planting and post planting care services;
- The Estimated Date of Planting is not a promise to fulfill by that date, but is merely an estimate of when the Vendor hopes to fulfill by.
- Plantagen owners agree to make a good faith attempt to fulfill each planting by its Estimated Date of Planting.
- Plantagen owners will create an escrow account and secure a part of the money that will ensure the upbringing of the trees from seeding and to, approximately 20 years, the optimal harvest time.
- Plantagen owners agree to make a good faith attempt to fulfill all services for the upbringing of the tree.
- The Plantagen owner will plant the trees on an area that is best suited for the specific tree type, to ensure an healthy and stabel growth throughout the total period og the trees upbringing.
- The land on which the tree is planted has to be on a seperat leasing contract under the whole periode of the upbringing, approximately 20 years. The leased contract will ensure the value of the tree being intact at time of harvest to be transferred back to the Ligaia platform for the redistribution program.
- Plantagen owners agree to make a good faith attempt to fulfill the harvesting and selling of the timber for the best price possible by its Estimated time of harvest.
- The plantagen will be managed in good faith to human rights and respect for nature and the local community.

All of the content of our website, including the Ligaia logo, is owned by us or our partners and is protected by Danish and international copyright laws. Please don’t download, copy or use any of our material for either private or commercial use.
Uploading images and other material
You must not upload, message, transmit or otherwise make available or initiate any content that:
- Is unlawful, libellous, abusive, obscene, discriminatory or otherwise objectionable;
- Includes information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

Questions to Ligaia and messages on our site
If you post questions for our experts or messages on our blogs or forums you own the copyright to this text. However, by posting text, you grant us unlimited free license to republish that text on our site and to redistribute, make available or sell that text in print or electronic form anywhere in the world as part of an edited compilation or otherwise.
Liability
We can’t promise that your access to our site, or its content, will be delivered uninterrupted or error-free, or that the site will be free from viruses or other harmful properties. It is your responsibility to put in place satisfactory safeguards and procedures to make sure that any material you obtain through our site is free from contaminations or other harmful properties.
We have taken every measure we can to prevent internet fraud and to ensure that any data collected from you is kept safe and secure. However, in the extremely unlikely event of a breach in our secure computer servers, we cannot be held liable.
Under no circumstances will we be held liable for any direct, indirect, incidental or other kind of loss or injury resulting from your use, or downloading of any content on our site.
The Legal Side
It is a crime to use a false name or a debit card or bank account that is known to be invalid. If you are caught entering false or fictitious information you will be prosecuted. Ligaia tracks the ‘fingerprint’ of every person who registers with us, to enable us and all legitimate crime prevention authorities to trace individuals engaged in criminal activities on our website.
Ligaia has the right to end our agreement with you and to suspend or terminate your access to the website if any of the following occurs:
- You breach our terms and conditions
- You fail to make a payment to us that is due
- You fail to provide, when asked, information to allow us to check your identity or the validity of any information you have given us
- We suspect you have been or are engaged in fraudulent or illegal activity on ligaia.com.
If you break any of these terms and conditions, or if liabilities are incurred as a result of your use of the website, you will be responsible for the costs and expenses, including legal fees, that we, or our employees, officers, directors or agents incur as a result. This will include any costs that result if someone else uses your personal information, or your Ligaia account, unless you can prove that it has been used fraudulently.

Handelsbetingelser og det digitale certifikat

Grønne Donationer vil gå til projekter eller non-profit organisationer ligesom ‘plantager til at nedbryde CO2′, ‘reetablering af originale regnskove’ eller bæredygtig energi.
Ved at donere, accepterer du at være bundet af hele denne aftale og de herunder følgende vilkår:
- Donorerne er enige om at give deres betalingsoplysninger på det tidspunkt, de forpligter sig til en donation. Beløbet størrelse donereren vælger er det beløb, der vil blive opkrævet.
- Donorer giver samtykke til at Ligaia og deres betalingspartnere bemyndiges til at reservere en betaling på donorens betalingskort eller anden betalingsmetode.
- Donationsbeløbet er opdelt i 3 dele: den “Humanitære donation”, “Grønne donation” og “Leasing og administrationsgebyrer”.
- Ligaia tilbyder ikke returret. Returretten gælder ikke donationer, hverken kontantbeløb eller certifikater. - Alle gebyrer er inkluderet i de angivne priser, medmindre der udtrykkeligt er beskrevet andet. Gebyrer kan variere i regioner og andre faktorer.
- Ligaia forbeholder sig ret til enhver tid at kunne annullere en donation og uanset årsag.
- Ligaia forbeholder sig ret til at afvise, annullere, afbryde, fjerne eller suspendere en leverandør til enhver tid og uanset årsag. Ligaia er ikke ansvarlig for eventuelle skader som følge af nogen af disse handlinger.
- Ligaia er ikke ansvarlig for skader eller tab, der er afholdt i forbindelse med donationen eller enhver anden brug af tjenesten. Ligaia er ikke forpligtet til at blive involveret i tvister mellem eventuelle brugere eller mellem brugere og tredjepart opstået i forbindelse med brug af tjenesten. Betaling
Dine betalinger til os går til den aftalte service konto og derefter videre til de 3 parter: “Humanitære donationer”, “Grøn donationer” og “Leasing og administrationsgebyrer”. Ligaia accepterer de fleste større betalingskort. Ligaia holder ikke på dine bankoplysninger . Hvis du giver disse oplysninger til os for at betale, vil disse blive videregivet til vores bankpartnere og holdes sikkert som med enhver anden bank transaktion.
Vores administrationsgebyr
Ligaia samtlige gebyr er inkluderet i prisen, som oplyst ved donation. Gebyret betaler for din adgang pr. enhed, fra køb og til høst, så du kan følge med i processen af “Humanitære og Grøn donationer” og stemme for overskudsfordeling efter høsten. Medmindre andet er angivet på tidspunktet for donationen, bliver der ikke tilføjet nogen månedligt gebyr.
Ændrer du mening
Hvis du registrerer dig og donere med Ligaia platform, og derefter ændrer mening, så lad os det vide. Vi kan ikke give nogen tilbagebetalinger, men vi kan annullere din konto, hvis du kontakter os skriftligt (link med support@ligaia.com). Hvis du annullerer din konto dit, vil du ikke kunne få adgang til dit certifikat i fremtiden heller ikke være i stand til at stemme for fremtidig donation distribution. Den annullering er permanent.
Returret:
Ligaia tilbyder ikke restitutioner. Retten til udbytte gælder ikke for donationer, uanset om kontanter eller certifikater. Denne donation vil blive udstedt til de valgte velgørenhed og velgørenhed organisation er ikke forpligtet til at give en Doner anmodning om tilbagebetaling. Heller ikke den doner ret til at kontakte velgørenhedsorganisation for restitutioner.

Partner betingelser (Plantageejere)
Den Plantagen ejer vil give oplysninger om: steder for træplantning, alder og kvaliteten af træplantning og post plantning pleje;
- Den forventede dato for Plantning er ikke et løfte om at opfylde denne dato, men er blot et skøn over, hvor sælger håber at opfylde med.
- Plantagen ejere er enige om at gøre en god tro forsøg på at opfylde hver plantning ved sin Anslået dato Plantning.
- Plantagen ejere vil skabe en spærret konto og sikre en del af de penge, der vil sikre opdragelsen af træerne fra såning og til, ca. 20 år, det optimale høsttidspunkt.
- Plantagen ejere er enige om at gøre en god tro forsøg på at opfylde alle tjenester til opdragelse af træet.
- Den Plantagen ejer vil plante træer på et område, der er bedst egnet til den specifikke træ type, for at sikre en sund og stabel vækst i hele den samlede periode og træerne opdragelse.
- Den jord, hvor træet er plantet skal være på en seperat leasingaftale under hele period af opdragelsen, cirka 20 år. Det leasede Kontrakten vil sikre værdien af træet bliver intakt på høsttidspunktet, der skal overføres tilbage til Ligaia platform for omfordeling programmet.
- Plantagen ejere er enige om at gøre en god tro forsøg på at opfylde høst og salg af træ til den bedst mulige pris ved sin Anslået høsttidspunktet.
- Det Plantagen vil blive forvaltet i god tro for menneskerettigheder og respekt for naturen og lokalsamfundet.
